Prize Draw Terms & Conditions

  1. The “Seeking Explorers” prize draw is open to residents of the UK, Channel Islands, Isle of Man and Republic of Ireland aged 21 years or over, holding an acceptable full bike licence, except employees or families of Triumph Motorcycles Ltd and Edelweiss Bike Travel.  Persons entering the prize draw should be prepared for and able to undertake a 1700 mile (2700 kms) motorcycle road trip.
  2. Details of how to enter form part of the terms and conditions.  It is a condition of entry that all rules are accepted as final and that the entrant agrees to abide by these rules.  The decision of the judges is final and no correspondence will be entered into.
  3. Entries must be submitted via www.triumphadventure.co.uk and entry is restricted to one per person.  Multiple entries will be disqualified.
  4. The closing date for entries is midnight on the 27th January 2012.
  5. One entrant will win the right to ride a Triumph Tiger Explorer motorcycle during a bespoke Triumph Adventure Tour (“Tour”) through Spain and Morocco provided by Edelweiss Bike Travel from 9th March 2012 to 20th March 2012.  There are no passengers allowed on the Tour.  The prize is all inclusive of flights, airport transfers in Spain, meals on the tour, drinks with evening meals on the tour, fuel for the tour, ferry costs, riding equipment (excluding helmets) and motor insurance for the Tiger Explorer loaned for the Tour.
    Subject to availability Triumph will provide the prize winner with a suitable riding jacket, riding trousers, boots and gloves.  pan, excluding helmets.  The prize winner is are not permitted to wear their own riding equipment other than a personal safety motorcycle helmet, unless previously agreed with Triumph. Triumph reserves the right to apply temporary adhesive logo’s to helmets for the duration of the Tour
  6. There is no cash alternative to the prize and the prize cannot be used in conjunction with any other offer. 
  7. The prize is open to all persons entering the “Seeking Explorers” competition.
  8. The prize is not transferable.
  9. In the event the winner cannot travel on the dates specified in these terms and conditions the prize will be forfeit.
  10. The departure airport and airline will be at the sole discretion of Triumph.  The winner is responsible for adhering to the terms and conditions of the flight ticket.
  11. The prize does not include travel insurance, travel between the winner’s home and the departure airport, personal expenditure or incidental costs, other than where stated in these terms and conditions.
  12. The prize winner is responsible for ensuring they have a valid passport and they obtain any necessary visas and vaccinations required or recommended for the trip.
  13. The prize winner is responsible for providing their own travel insurance, which must cover Spain and Morocco.
  14. The winner will be selected at random from all qualifying entries.  The prize draw will be made on 31st January 2012 and the winner will be notified by telephone or email within 7 days.  Should the Promoter be unable to contact the winner within 7 days or should the winner be unable to accept the prize, the Promoter reserves the right to award the prize to an alternative winner, drawn in accordance with these terms and conditions.
  15. The prize winner will be required to present their original full motorcycle licence and travel insurance documentation (“Documents”) to Edelweiss and Triumph staff prior to the loan of the Triumph motorcycle.  The supply of documents is a prerequisite of the loan of the Triumph motorcycle. 
  16. The prize winner must agree to all terms and conditions required by Edelweiss Bike Travel, these are available upon request. The prize winner must sign all forms including waivers required by Edelweiss Bike Travel, provided below. 
  17. No modifications may be made to the Triumph motorcycle loaned.
  18. The winner’s name and county can be obtained by sending an SAE to Seeking Explorers Prize Draw Winner,  Triumph UK, Jacknell Road, Hinckley, LE10 3BS between 31st January 2012 and 28th February 2012.
  19. The winner agrees to participate in any publicity. 
  20. The Triumph name, logo and trademarks are copyright protected property of Triumph.  Triumph obtains the right to take photographs of the winner.  All photographs and depictions of the winner and the Tour are exclusive property of Triumph for commercial use in Triumph’s sole discretion with no compensation to the winners.  Triumph obtains the right to use the winner’s name and images to Triumph’s commercial benefit in the public domain via social media of Triumph’s choosing, including, but not limited to, Facebook, Twitter, YouTube, MySpace, Google+, Bebo, Flickr and/or Tumblr. No photographs or depictions of the Tour may be reproduced, copied, displayed, distributed, republished, uploaded, posted, or transmitted by prize winners without written permission from Triumph in any way for any commercial purpose.  Any use of Tour materials for any purpose without the written permission from Triumph is a violation of Triumph’s copyright and/or other proprietary rights.  The trademarks, logos and service marks ("Marks") of Triumph are the property of Triumph, its affiliates or other third parties. Nothing during the Tour should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Mark displayed on the Tour without the written permission of Triumph. The prize winner’s misuse of the Marks displayed on the Tour, or any other content on the Tour, is strictly prohibited. The prize winner is advised that Triumph will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
  21. The prize draw and Tour are governed by the laws of England. 
  22. The promoter reserves the right to amend, alter or withdraw the promotion at any time without prior notice. 
  23. Any claim, dispute, or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including, but not limited to, statutory, common law, intentional tort and equitable claims) arising from or relating to the Prize, the Tour, the interpretation or application of these Terms and Conditions or the breach, termination or validity thereof, the relationships which result from these Terms and Conditions or any of Triumph’s advertising or marketing (collectively, a "Claim") WILL BE RESOLVED, UPON THE ELECTION OF ANY OF TRIUMPH, A PRIZE WINNER’S OR THE THIRD PARTIES INVOLVED, EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. If arbitration is chosen, it will be conducted pursuant to the rules of the American Arbitration Association. If arbitration is chosen by any party with respect to a Claim, neither Triumph nor the Prize Winner will have the right to litigate that Claim in court or to have a jury trial on that Claim or to engage in pre-arbitration discovery, except as provided for in the applicable arbitration rules or by agreement of the parties involved. Further, the Prize Winner will not have the right to participate as a representative or member of any class of claimants pertaining to any Claim. The arbitration will take place exclusively in White Plains, New York. Any court having jurisdiction may enter judgment on the award rendered by the arbitrator(s). Each party involved will bear its own cost of any legal representation, discovery or research required to complete arbitration. The existence or results of any arbitration will be treated as confidential.

Rider Waiver Terms
1. The participant understands that there are risks and hazards inherent in the operation of any motorcycle. The undersigned assumes all risks, hazards, and dangers associated with his/her participation in the Tour.  The participant agrees to bear the sole responsibility for any civil and criminal actions that may arise from any personal injuries or property damage caused by himself/herself or his/her operation of the Tiger motorcycle.
2. The participant waives all rights to assert any claim against Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages, including damages based upon negligence, gross negligence, any alleged product defect or any other claim, allegedly arising out of the use of the Tiger motorcycle.
The participant forever waives all rights to sue Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages, including damages based upon negligence, gross negligence, any alleged product defect or any other claim, allegedly arising out of the use of the Tiger motorcycle. The participant understands and agrees that this waiver is binding on all his/her family members, heirs and assigns.
3. The participant will forever hold Edelweiss, related companies, business partners, insurance companies, related companies and all their employees harmless for any and all claims, demands and lawsuits, including claims of negligence, gross negligence, any alleged product defect or any other claim, made by anyone against Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages arising out of the use of the Tiger motorcycle.
4. The participant hereby declares that he/she has a valid unrevoked drivers license that allows him/her to operate motorcycles.  The participant also states that he/she has the necessary riding skills to safely ride the Tiger motorcycle.  
5. The participant agrees to refrain from riding the Tiger motorcycle after consuming alcohol or drugs.  The participant acknowledges that it is illegal to operate the subject motorcycle while under the influence of alcohol or drugs.  The participant agrees to accept sole responsibility for any and all fines and damages arising from the operation of the Tiger motorcycle under the influence of alcohol and/or drugs.
6. Off road riding outside the tour route is not allowed.  The participant agrees that any damage caused by unauthorized off-road riding will have to be paid in full by the participant without any deductible. 
7. The participant acknowledges that the motorcycle being provided by Edelweiss has been operated in the past.  The participant will be responsible for inspection of the motorcycle before each and every ride.  The participant acknowledges that he/she has examined the loaned Tiger motorcycle and states that it is in safe operating condition. If the participant has any concerns about the ability for the motorcycle to be operated safety, the participant will refrain from the use of the motorcycle and will inform Edelweiss about any reasons for concerns about the safety of the motorcycle.
8. The participant agrees to comply with all traffic laws while operating the Tiger motorcycle.  The participant agrees to wear a helmet.  The participant also acknowledges that Edelweiss recommended that all tour participants wear gloves, boots, eye protection, long sleeves and long pants while operating the Tiger motorcycle.
9. The participant agrees that Edelweiss and/or Triumph shall have the right to use his/her name, likeness and endorsement or any reproduction thereof, in any form, style or color, together with any writing or other advertising material in connection therewith including, but not limited to television commercials, documentary films, magazine and newspaper ads, point of purchase materials, and other materials referring to participant’s preference for Edelweiss Tours and/or Triumph motorcycles.
10. The participant agrees that Edelweiss and/or Triumph have the right to contact him/her by telephone or e-mail or mail.
The participant acknowledges that he/she understands English.  The participant acknowledges that he/she read and understood this waiver.  The participant agrees to the terms of this waiver.

 

 

Triumph Adventure Tour – Morocco Sweepstakes - USA and Canada

Official Rules

1. Eligibility: The Triumph Adventure Tour – Morocco Sweepstakes (the “Sweepstakes”) is open only to legal residents of Canada and the fifty (50) United States (including District of Columbia) who are at least twenty-one (21) years old at the time of entry and possess a valid, government-issued motorcycle license.  Officers, directors employees, agents and representatives of both Triumph Motorcycles Ltd. and Edelweiss Bike Travel, any independent sweepstakes judging organization, and each of their respective parent and affiliate companies, agencies, suppliers of materials and services related to this Sweepstakes, as well as their family (defined as parents, siblings, children and spouses, regardless of where they live) and household members (whether or not related) of such officers, directors, employees, agents and representatives are not eligible to enter or win.  Subject to all federal, state, provincial, and local laws, directives, and regulations.  Void where prohibited.  Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.  Winning a prize is contingent upon fulfilling all requirements set forth herein.  


2. Sponsor: Triumph Motorcycles Ltd., Normandy Way, Hinckley, Leicestershire, LE10 3BZ United Kingdom.


3. Timing:  The Sweepstakes begins at 12:00:01 AM Eastern Time (“ET”), November 8, 2011, and ends at 11:59:59 PM ET, January 27, 2012 (the “Promotion Period”).  Sponsor’s computer is the official time keeping device for the Sweepstakes.

4. How to Enter: 

(a)  NO PURCHASE NECESSARY.  Internet access required.  During the Promotion Period, visit www.triumphadventure.com and complete and submit the online registration form, including your first and last name, telephone number (including area code), a valid email address and home mailing address.  P.O. Boxes are not permitted.  Limit: One (1) entry per person.  Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified.  

(b)  Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, garbled, unintelligible or misdirected entries, which are void.  In the event of a dispute as to the identity of the person who submitted any entry, the authorized account holder of the email address used to enter will be deemed to be the registrant or entrant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  Potential winners may be required to show proof of being the authorized account holder.

(c)  Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Sweepstakes for the purposes of administering the Sweepstakes and prize fulfillment.  You may be offered the opportunity to receive additional communications from Sponsor about its products, and upcoming contests and promotions.  The personal data an entrant submits upon entry will be stored on servers in the United States of America and in Leicestershire, United Kingdom and the personal information you provide may therefore also be subject to the laws of the United States and/or the laws of the United Kingdom.  Entry into the Sweepstakes from outside of the U.S. constitutes entrant's consent to the export of his/her personal data to the United States of America and its use there for the purposes of administering this Sweepstakes and associated processing (e.g., but not limited to back-up, archiving).  All information submitted to the Sponsor as part of this Sweepstakes will be treated in accordance with the Sponsor’s privacy policy, available at http://www.triumphmotorcycles.co.uk/the-triumph-company/legal/privacy-policy.  

5.  Selection and Verification of Potential Winners: Sponsor will divide all eligible entries into two pools (each a “National Pool” or collectively, “National Pools”): a pool of eligible entrants who reside in the United States and a pool of eligible entrants who reside in Canada.  Sponsor will conduct a random drawing and select one (1) potential winner from each National Pool.  The drawing will take place at Sponsor’s headquarters at Normandy Way, Hinckley, Leicestershire, United Kingdom, on January 31, 2012 at 11:00 a.m. local time.  Sponsor will notify each potential winner by email and/or telephone at the email address and/or telephone number provided by the entrant at the time of Sweepstakes entry within seven (7) days after the date of the random draw.  Please check your email and spam filters.  If a selected entrant is a resident of Canada, before being declared a winner, he/she must first correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone.  The potential winners will be required to sign and return a Declaration of Eligibility/Liability Release (“Declaration”), which must be received back by Sponsor within ten (10) days of the date notice is sent by Sponsor in order to claim the prize, releasing the Sponsor, any independent contest judging organization, their respective parent, related and affiliated companies, advertising and promotional agencies, participating retailers, and all of their respective directors, officers, owners, partners, shareholders, employees, agents, representatives, successors and assigns from any liability in connection with this Sweepstakes or the use or misuse or possession of any prize.  If a potential winner cannot be contacted for any reason, fails to sign and return the Declaration within the required time period, or other non-compliance with these Official Rules, or if potential winner is a resident of Canada, fails to correctly answer the skill-testing question (as outlined above), potential winner forfeits the prize and Sponsor reserves the right, in its sole discretion, to randomly select an alternative entrant from the remaining entries in the applicable National Pool, who will be subject to disqualification in the same manner.  Because the prize is limited to a particular time frame, there will be no more than three (3) alternate drawings per National Pool, after which the applicable prize will remain unawarded for that National Pool, time permitting. Once the executed Declaration is received and verified by Sponsor within the required time frame, the entrant is deemed to be a Grand Prize Winner, subject to compliance with all applicable rules set forth herein.  Any misrepresentation on the Declaration shall void the winner’s eligibility and Sponsor shall disqualify such person and seek return of any prize elements already awarded to such person or the value thereof.    

6. Prize: 

(a)  There are a total of two (2) GRAND PRIZES available to be won (One (1) Per National Pool), each consisting of one (1) Triumph Adventure Tour (“Tour”) for the winner through Spain and Morocco provided by Edelweiss Bike Travel departing on March 9, 2012 and returning on March 20, 2012 on a Triumph Motorcycle, as outlined below, all at Sponsor’s sole discretion.  PRIZE DOES NOT INCLUDE OWNERSHIP OF ANY MOTORCYCLE.  Each Grand Prize includes: 

Return air transportation from major international airport closest to home residence of winner (itinerary at Sponsor’s discretion); 

Airport transfers to/from airports in Spain and Morocco;

Three (3) meals per day during the Tour, as determined/provided by Sponsor;

Motorcycle fuel and maintenance during the Tour, as required; 

Hotel and other accommodation during the Tour; and

Riding equipment, including: riding jacket, riding trousers, boots and gloves.  WINNERS MUST PROVIDE THEIR OWN HELMETS.  Sponsor reserves the right to apply temporary adhesive logos to helmets for the duration of the Tour.

Approximate Retail Value (“ARV”) of each Grand Prize: $7800 USD (based on a sample departure city of Chicago).  

(b)  The Grand Prize winner must possess all required travel documents, including visas and valid passports, as applicable, prior to ticketing and comply with any applicable hotel check-in requirements, such as presentation of a major credit card.  All aspects of the Tour must be arranged through Sponsor and conducted on such dates as determined by Sponsor in its sole discretion.  The dates of departure and return are subject to change at Sponsor’s sole discretion.  Government taxes, Passenger Facility Charge or September 11th Security Fee may be additional.  Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles or other reward point accumulation program.  Other travel restrictions may apply.  All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.  The ARV may vary depending upon date of booking, points of departure, date of travel, changes in exchange rates, and destination and fare fluctuations.  Sponsor reserves the right to structure travel routes and select hotels in its sole discretion.  The Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules.  No cash or other substitution permitted; however, the Sponsor reserves the right to substitute a prize of equal or greater monetary value, in cash or otherwise, at its sole discretion, if a prize, or any component of any prize, cannot be awarded for any reason.    Room taxes and other hotel fees are not included and if applicable may be payable at the time of check-out by the Grand Prize winner. In the event the winner engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to send the winner home with no further compensation.  All expenses and incidental travel costs not expressly stated in the description above, including but not limited to, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, insurance of any kind, security fees, taxes, gratuity or other expenses are the sole responsibility of the winner, as permitted by law. Sponsor is not responsible if winner is denied access to the aircraft, destination country or re-entry to country of residence.  In such an event, winner will be solely responsible for any expenses incurred and the Grand Prize may be forfeited, in whole or in part.  For purposes of clarity, potential winners will be required to present an original Full Bike Licence and Travel insurance documentation (“Documents”) to Edelweiss or Sponsor’s staff prior to the loan of the Sponsor motorcycles.  The supply of Documents is a prerequisite of the loan of the Sponsor motorcycle.  

(c)  Odds of being selected as eligible to win a prize depend on the total number of eligible entries in each National Pool. TOTAL ARV OF ALL PRIZES: $15,600 USD.

7. Release: By participating in this Sweepstakes and receipt of a prize, each winner agrees to release and hold harmless Sponsor, Edelweiss Bike Travel, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.  Potential winners will be required to execute additional releases and assumption of risk documents in order to be awarded a prize.  

 8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winners consent to Sponsor’s use of winner’s name, country of residence, picture, biographical information, statements, voice and likeness for promotional purposes in any advertising and publicity Sponsor may conduct relating to the Sweepstakes in any media or format, worldwide, whether now known or hereafter developed, without further notice, payment or consideration.  No photographs or depictions of the Tour may be reproduced, copied, displayed, distributed, republished, uploaded, posted, or transmitted by prize winners without written permission from Sponsor in any way for any commercial purpose.  Any use of Tour materials for any purpose without the written permission from Sponsor is a violation of Sponsor’s copyright and/or other proprietary rights.  The trademarks, logos and service marks (“Marks”) of Sponsor are the property of Sponsor, its affiliates or other third parties.  Nothing during the Tour should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Mark displayed on the Tour without the written permission of Sponsor.  The prize winner’s misuse of the Marks displayed on the Tour, or any other content on the Tour, is strictly prohibited.  The prize winners are advised that Sponsor will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

9. General Conditions: All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and/or subject to the approval of the Régie des alcools, des courses et des jeux, to cancel, terminate, modify or suspend the Sweepstakes.  Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

  10. Limitations of Liability: Released Parties are not responsible for:  (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software (beyond Sponsor’s reasonable control); (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (6) garbled transmissions or miscommunications; (7) failure of any e-mail to be received by or from any Sweepstakes judging organization or Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (8) technical, pictorial, typographical or editorial errors or omissions contained herein or (9) any injury or damage to property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize (other than as a direct result of the Sponsor's negligence).  No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims for the relevant affected National Pool.  

11. Triumph Adventure Tour - Morocco Competition - Australia 

Competition Terms & Conditions

Prize: Single entry right to ride a Triumph motorcycle during a bespoke Triumph Adventure Tour (“Tour”) through Spain and Morocco provided by Edelweiss Bike Travel from 9th March 2012 to 20th March 2012. There are no passengers allowed on the Tour. The prize is all inclusive of flights, airport transfers, meals, drinks with evening meals, fuel, ferry costs and riding equipment (excluding helmets).

No Cash Alternative: There is no cash alternative to the prize and the prize cannot be used in conjunction with any other offer.

Eligibility: The prize is open to all persons entering the “Seeking Explorers” competition, aged 21 years or over, holding a full bike licence, except employees of Triumph Motorcycles Ltd and Edelweiss Bike Travel. Persons entering the competition should be prepared for and able to undertake a 1700 mile (2700 kms) motorcycle road trip.

One Entry Per Person: Only one entry per person.

Entry Deadline: The closing date for entries is 27th January 2012.

No Modifications to Bikes: No modifications may be made to the Triumph bikes.

Selection of Prize Winners: Winners will be selected at random. The prize draw will be made on 31st January 2012 and the winners will be notified by telephone or email within 7 days.

Number of Prize Winners: 13 winners will be selected.

Notification of Prize Winners:

Details of winners will be posted on the Triumph Motorcycles Limited web sites from 13th February 2012 for a minimum of 30 days. Triumph Motorcycles Ltd and Edelweiss Bike Travel will not enter into correspondence regarding any aspects of the prize.

Equipment: Triumph will provide prize winners with all riding equipment, excluding helmets. Prize winners are not permitted to wear their own riding equipment other than a personal safety motorcycle helmet. Triumph reserves the right to apply temporary adhesive logo’s to helmets for the duration of the Tour.

Travel Insurance: Prize winners are responsible for providing their own travel insurance that must cover Spain and Morocco.

Motor Insurance: Motor vehicle insurance will be covered by Triumph Motorcycle.

Proof of Full Bike Licence & Travel Insurance: Prize winners will be required to present original Full Bike Licence and Travel insurance documentation (“Documents”) to Edelweiss or Triumph staff prior to the loan of the Triumph motorcycles. The supply of documents is a prerequisite of the loan of the Triumph motorcycle.

Publicity/Copyright: All entrants must agree to participate in any publicity. The Triumph name, logo and trademarks are copyright protected property of Triumph. Triumph obtains the right to take photographs of all winners. All photographs and depictions of the winners and the Tour are exclusive property of Triumph for commercial use in Triumph’s sole discretion with no compensation to the winners. Triumph obtains the right to use winners’ names and images to Triumph’s commercial benefit in the public domain via social media of Triumph’s choosing, including, but not limited to, Facebook, Twitter, YouTube, MySpace, Google+, Bebo, Flickr and/or Tumblr. No photographs or depictions of the Tour may be reproduced, copied, displayed, distributed, republished, uploaded, posted, or transmitted by prize winners without written permission from Triumph in any way for any commercial purpose. Any use of Tour materials for any purpose without the written permission from Triumph is a violation of Triumph’s copyright and/or other proprietary rights. The trademarks, logos and service marks ("Marks") of Triumph are the property of Triumph, its affiliates or other third parties. Nothing during the Tour should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Mark displayed on the Tour without the written permission of Triumph. The prize winner’s misuse of the Marks displayed on the Tour, or any other content on the Tour, is strictly prohibited. The prize winners are advised that Triumph will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

Consent to Terms & Conditions of Edelweiss Bike Travel: Prize winners must agree to all terms and conditions required by Edelweiss Bike Travel. The prize winners must sign all forms including waivers required by Edelweiss Bike Travel.

Choice of Law: The contest and Tour are governed by the laws of England.

Right To Terminate: Triumph Motorcycles reserves the right to amend, alter or withdraw the promotion at any time without prior notice.
Arbitration: Any claim, dispute, or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including, but not limited to, statutory, common law, intentional tort and equitable claims) arising from or relating to the Prize, the Tour, the interpretation or application of these Terms and Conditions or the breach, termination or validity thereof, the relationships which result from these Terms and Conditions or any of Triumph’s advertising or marketing (collectively, a "Claim") WILL BE RESOLVED, UPON THE ELECTION OF ANY OF TRIUMPH’S, A PRIZE WINNER’S OR THE THIRD PARTIES INVOLVED, EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. If arbitration is chosen, it will be conducted pursuant to the rules of the American Arbitration Association. If arbitration is chosen by any party with respect to a Claim, neither Triumph nor the Prize Winner will have the right to litigate that Claim in court or to have a jury trial on that Claim or to engage in pre-arbitration discovery, except as provided for in the applicable arbitration rules or by agreement of the parties involved. Further, the Prize Winner will not have the right to participate as a representative or member of any class of claimants pertaining to any Claim. The arbitration will take place exclusively in White Plains, New York. Any court having jurisdiction may enter judgment on the award rendered by the arbitrator(s). Each party involved will bear its own cost of any legal representation, discovery or research required to complete arbitration. The existence or results of any arbitration will be treated as confidential.

Rider Waiver Terms

1. The participant understands that there are risks and hazards inherent in the operation of any motorcycle. The undersigned assumes all risks, hazards, and dangers associated with his/her participation in the Tour. The participant agrees to bear the sole responsibility for any civil and criminal actions that may arise from any personal injuries or property damage caused by himself/herself or his/her operation of the Tiger motorcycle.
2. The participant waives all rights to assert any claim against Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages, including damages based upon negligence, gross negligence, any alleged product defect or any other claim, allegedly arising out of the use of the Tiger motorcycle.
The participant forever waives all rights to sue Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages, including damages based upon negligence, gross negligence, any alleged product defect or any other claim, allegedly arising out of the use of the Tiger motorcycle. The participant understands and agrees that this waiver is binding on all his/her family members, heirs and assigns.
3. The participant will forever hold Edelweiss, related companies, business partners, insurance companies, related companies and all their employees harmless for any and all claims, demands and lawsuits, including claims of negligence, gross negligence, any alleged product defect or any other claim, made by anyone against Edelweiss, related companies, business partners, insurance companies, related companies and all their employees for any and all damages arising out of the use of the Tiger motorcycle.
4. The participant hereby declares that he/she has a valid unrevoked drivers license that allows him/her to operate motorcycles. The participant also states that he/she has the necessary riding skills to safely ride the Tiger motorcycle.
5. The participant agrees to refrain from riding the Tiger motorcycle after consuming alcohol or drugs. The participant acknowledges that it is illegal to operate the subject motorcycle while under the influence of alcohol or drugs. The participant agrees to accept sole responsibility for any and all fines and damages arising from the operation of the Tiger motorcycle under the influence of alcohol and/or drugs.
6. Off road riding outside the tour route is not allowed. The participant agrees that any damage caused by unauthorized off-road riding will have to be paid in full by the participant without any deductible.
7. The participant acknowledges that the motorcycle being provided by Edelweiss has been operated in the past. The participant will be responsible for inspection of the motorcycle before each and every ride. The participant acknowledges that he/she has examined the loaned Tiger motorcycle and states that it is in safe operating condition. If the participant has any concerns about the ability for the motorcycle to be operated safety, the participant will refrain from the use of the motorcycle and will inform Edelweiss about any reasons for concerns about the safety of the motorcycle.
8. The participant agrees to comply with all traffic laws while operating the Tiger motorcycle. The participant agrees to wear a helmet. The participant also acknowledges that Edelweiss recommended that all tour participants wear gloves, boots, eye protection, long sleeves and long pants while operating the Tiger motorcycle.
9. The participant agrees that Edelweiss and/or Triumph shall have the right to use his/her name, likeness and endorsement or any reproduction thereof, in any form, style or color, together with any writing or other advertising material in connection therewith including, but not limited to television commercials, documentary films, magazine and newspaper ads, point of purchase materials, and other materials referring to participant’s preference for Edelweiss Tours and/or Triumph motorcycles.
10. The participant agrees that Edelweiss and/or Triumph have the right to contact him/her by telephone or e-mail or mail.
The participant acknowledges that he/she understands English. The participant acknowledges that he/she read and understood this waiver. The participant agrees to the terms of this waiver.

Teilnahmebedingungen

 

Preis: Einmalige Berechtigung an einer von Edelweiss Bike Travel vom 9. März 2012 bis 20. März 2012 speziell ausgerichteten Triumph Adventure Tour („Tour“) durch Spanien und Marokko mit einem Motorrad von Triumph teilzunehmen. Bei der Tour sind keine Mitfahrer gestattet. Der Preis versteht sich inklusive Flug, Flughafentransfer, Mahlzeiten, Getränke zum Abendessen, Treibstoff, Überfahrtkosten mit der Fähre und Motorradausstattung (mit Ausnahme der Helme).

Barauszahlung ausgeschlossen: Der Preis kann weder in bar ausgezahlt noch mit anderen Angeboten verrechnet werden.

Teilnahmevoraussetzungen: Teilnahmeberechtigt sind alle Personen, die mindestens 21 Jahre alt sind und einen Motorradführerschein (Klasse A) besitzen. Mitarbeiter von Triumph Motorcycles Ltd und Edelweiss Bike Travel sind von der Teilnahme ausgeschlossen. Personen, die an diesem Preisausschreiben teilnehmen, sollten auf eine 2700 km lange Motorrad-Tour vorbereitet und dazu in der Lage sein.

Nur eine Einsendung pro Person: Pro Person ist nur eine Einsendung zulässig.

Nachweis des Motorradführerscheins (Klasse A) und der Reiseversicherung: Die Gewinner sind verpflichtet, vor dem Verleih der Motorräder von Triumph gegenüber Mitarbeitern von Edelweiss oder Triumph den Nachweis eines Motorradführerscheins (Klasse A) sowie von Reiseversicherungsunterlagen („Unterlagen“) zu erbringen. Die Vorlage der Unterlagen ist Voraussetzung für den Verleih des Motorrads von Triumph.

Veröffentlichung/Copyright: Alle Teilnehmer erklären sich mit jeglicher Form der Veröffentlichung einverstanden. Der Name, das Logo und die Markenzeichen von Triumph sind urheberrechtlich geschütztes Eigentum von Triumph. Triumph behält sich das Recht vor, alle Gewinner zu fotografieren. Alle Fotografien und Abbildungen der Gewinner und der Tour sind das alleinige Eigentum zur kommerziellen Nutzung von Triumph und bedürfen keinerlei Einwilligung oder Entschädigung der Gewinner. Triumph behält sich das Recht vor, die Namen und Bilder der Gewinner zur kommerziellen Nutzung in Sozialen Netzwerken zu veröffentlichen. Die Auswahl der Netzwerke obliegt Triumph und beinhaltet Facebook, Twitter, YouTube, MySpace, Google+, Bebo, Flickr und/oder Tumblr. Die Markenzeichen, Logos und Dienstleistungsmarken („Marken“) von Triumph sind Eigentum von Triumph, dessen verbundenen Unternehmen oder anderen Unternehmen. Ohne die schriftliche Genehmigung von Triumph darf nichts auf der Tour stillschweigend, durch Verwirkung oder auf andere Weise, als Genehmigung ausgelegt werden, eine Lizenz oder ein Recht zur Nutzung von Marken, die auf der Tour gezeigt werden, zu erhalten. Die missbräuchliche Verwendung von Marken, die auf der Tour gezeigt werden, oder irgendwelcher anderer Inhalte der Tour, ist streng verboten. Triumph weist die Gewinner darauf hin, dass das Unternehmen seine Urheberrechte mit aller Kraft und in vollem Umfang des Gesetzes durchsetzen wird, einschließlich der Forderung von strafrechtlicher Verfolgung.

Zustimmung zu den Geschäftsbedingungen von Edelweiss Bike Travel: Die Gewinner müssen den Geschäftsbedingungen von Edelweiss Bike Travel in vollem Umfang zustimmen. Die Gewinner müssen alle von Edelweiss Bike Travel angeforderten Formulare, einschließlich Verzichtserklärungen, unterzeichnen.

Wird ein Schiedsverfahren ausgewählt, wird es nach der Schiedsordnung der American Arbitration Association durchgeführt. Wird ein Schiedsverfahren von einer der Parteien in Bezug auf einen Anspruch gewählt, haben weder Triumph noch der Gewinner das Recht, diesen Anspruch vor Gericht oder vor ein Schwurgericht zu bringen, oder der Möglichkeit einer Beweisabnahme vor dem Schiedsverfahren (engl. „Pre-Arbitration Discovery“) nachzugehen, außer dies entspricht der anwendbaren Schiedsordnung oder einer Vereinbarung der beteiligten Parteien. Des Weiteren steht dem Gewinner nicht das Recht zu, als Vertreter oder Mitglied einer Gemeinschaft von Klägern in Verbindung mit irgendeinem Anspruch aufzutreten. Das Schiedsverfahren findet ausschließlich in White Plains, New York, statt. Jedes zuständige Gericht kann ein Urteil über die Entscheidung des/der Schiedsrichter(s) fällen. Verzichtserklärung Motorradfahrer
1. Der Teilnehmer ist sich der Risiken und Gefahren bewusst, die mit dem Betrieb jedes Motorrads einhergehen. Der Unterzeichnende übernimmt alle Risiken und Gefahren, die mit seiner Teilnahme an der Tour verbunden sind. Der Teilnehmer verpflichtet sich, die alleinige Verantwortung für jegliche zivil- und strafrechtliche Verfahren zu tragen, die sich aus Personen- oder Sachschäden ergeben können, welche durch ihn/sie selbst oder durch seinen/ihren Betrieb des Tiger-Motorrads verursacht wurden.
2. Der Teilnehmer verzichtet auf alle Rechte an jeglichen Ansprüche gegen Edelweiss, dessen verbundene Unternehmen, Geschäftspartner, Versicherungen, deren verbundene Unternehmen und alle ihre Mitarbeiter für jegliche Schäden, einschließlich Schäden, die auf Fahrlässigkeit, grobe Fahrlässigkeit, einen angeblichen Defekt des Produkts oder sonstige Ansprüche beruhen, die sich angeblich aus der Verwendung des Tiger-Motorrads ergeben.
Der Teilnehmer verzichtet für alle Zeit auf alle Rechte Edelweiss, dessen verbundene Unternehmen, Geschäftspartner, Versicherungen, deren verbundene Unternehmen und alle ihre Mitarbeiter für jegliche Schäden zu verklagen, einschließlich Schäden, die auf Fahrlässigkeit, grobe Fahrlässigkeit, einen angeblichen Defekt des Produkts oder sonstigen Ansprüche beruhen, die sich angeblich aus der Nutzung des Tiger-Motorrads ergeben. Der Teilnehmer versteht und stimmt zu, dass dieser Verzicht für alle seine/ihre Familienmitglieder, Erben und Rechtsnachfolger verbindlich ist.
3. Der Teilnehmer hält Edelweiss, dessen verbundene Unternehmen, Geschäftspartner, Versicherungen, deren verbundene Unternehmen und alle ihre Mitarbeiter frei von jeglichen Ansprüchen, Forderungen und Klagen, einschließlich Ansprüchen, die auf Fahrlässigkeit, grober Fahrlässigkeit, einem angeblichen Defekt des Produkts oder sonstigen Ansprüchen basieren, die von irgendeiner Person gegen Edelweiss, dessen verbundene Unternehmen, Geschäftspartner, Versicherungen, deren verbundene Unternehmen und alle ihre Mitarbeiter aufgrund irgendwelcher Schäden erhoben werden und sich aus der Nutzung des Tiger-Motorrads ergeben.
4. Der Teilnehmer bestätigt hiermit, dass er/sie sich im Besitz eines gültigen Führerscheins befindet, der ihm/ihr das Fahren von Motorrädern gestattet. Der Teilnehmer bestätigt ferner, dass er/sie die nötigen Fähigkeiten besitzt, um das Tiger-Motorrad zu bedienen.
5. Der Teilnehmer verpflichtet sich, vom Fahren des Tiger-Motorrads nach dem Konsum von Alkohol oder Drogen abzusehen. Der Teilnehmer erkennt an, dass es illegal ist, ein Motorrad unter Alkohol- oder Drogeneinfluss zu betreiben. Der Teilnehmer verpflichtet sich, die alleinige Verantwortung für jegliche Geldstrafen und Schäden zu übernehmen, die aus dem Betrieb des Tiger-Motorrads unter Alkohol- oder Drogeneinfluss resultieren.
6. Das Fahren auf unbefestigten Straßen jenseits der Tour-Route ist nicht gestattet. Der Teilnehmer stimmt zu, das jegliche Schäden, die durch nicht autorisiertes Fahren auf unbefestigten Straßen verursacht werden, in voller Höhe ohne Abzug vom Teilnehmer zu entschädigen sind.
7. Der Teilnehmer erkennt an, dass das durch Edelweiss bereitgestellte Motorrad in der Vergangenheit bereits betrieben wurde. Der Teilnehmer ist für die Kontrolle des Motorrads vor jeder Fahrt verantwortlich. Der Teilnehmer bestätigt, dass er/sie das geliehene Tiger-Motorrad kontrolliert hat und erklärt, dass es sich in sicherem Betriebszustand befindet. Wenn der Teilnehmer irgendwelche Bedenken bezüglich der Eignung des Motorrads für einen sicheren Betrieb hat, verzichtet der Teilnehmer auf die Nutzung des Motorrads und informiert Edelweiss über jegliche Gründe für seine Bedenken bezüglich der Sicherheit des Motorrads.
8. Der Teilnehmer verpflichtet sich während des Betriebs des Tiger-Motorrads zur Einhaltung aller Verkehrsregeln. Der Teilnehmer verpflichtet sich, einen Helm zu tragen. Der Teilnehmer bestätigt ferner, dass Edelweiss allen Teilnehmern der Tour empfiehlt, während des Betriebs des Tiger-Motorrads Handschuhe, Stiefel, Schutzbrille, lange Ärmel und lange Hosen zu tragen.
9. Der Teilnehmer ist damit einverstanden, dass Edelweiss und/oder Triumph das Recht haben, seinen/ihren Namen, seine/ihre Fürsprache und Billigung oder irgendeine Reproduktion dessen in irgendeiner Form, Art oder Ausprägung zu nutzen, zusammen mit jeglichen Schriftstücken oder anderen Werbemitteln im Zusammenhang mit (einschließlich, aber nicht beschränkt auf) TV-Werbespots, Dokumentationen, Magazin- und Zeitungsanzeigen, Point-of-Purchase-Materialien und andere Materialien, die sich auf die Vorliebe des Teilnehmers für Edelweiss Tours und/oder Triumph Motorcycles Limited beziehen. 10. Der Teilnehmer stimmt zu, dass Edelweiss und/oder Triumph das Recht haben, per Telefon, E-Mail oder Post Kontakt zu ihm/ihr aufzunehmen.
Der Teilnehmer bestätigt, dass er/sie Englisch versteht. Der Teilnehmer bestätigt, dass er/sie diese Verzichtserklärung gelesen und verstanden hat. Der Teilnehmer stimmt den Bedingungen dieser Verzichtserklärung zu.

 

 

 

 

 

Triumph Adventure Tour - Competición de Marruecos

Términos y condiciones de la competición

Premio: El derecho individual a montar en una moto Triumph durante el Triumph Adventure Tour personalizado (“Tour”) a través de España y Marruecos, ofrecido por Edelweiss Bike Travel, desde el 9 de marzo hasta el 20 de marzo de 2012. No se permiten pasajeros acompañantes en el tour. El premio incluye los vuelos, trasbordos a y desde el aeropuerto, comidas, bebidas con las cenas, combustible, costes del ferry y equipamiento para montar (con la exclusión de los cascos).

No hay premio en efectivo como alternativa: El premio no se puede canjear por dinero en efectivo ni se puede utilizar en combinación con ninguna otra oferta.

Las personas que se inscriban en la competición deberán estar preparadas y ser capaces de emprender un viaje en moto por carretera de 1700 millas (2700 km).

Una solicitud por persona: Solamente se puede hacer una inscripción por persona.

Fecha límite para la inscripción: La fecha de cierre para la aceptación de solicitudes es el 27 de enero de 2012.

No se permiten modificaciones en las motos: No está permitido hacer modificaciones a las motos Triumph.

Selección de los ganadores de premios: Los ganadores serán seleccionados al azar. El premio se decidirá por sorteo el 31 de enero de 2012 y los ganadores serán notificados por teléfono o por correo electrónico en un plazo de 7 días.

Número de ganadores de premios: Se seleccionará a 13 ganadores.

Notificación de los ganadores de premios:

Los detalles sobre los ganadores serán publicados en los sitios web de Triumph Motorcycles Limited a partir del 13 de febrero de 2012 durante un mínimo de 30 días. Triumph Motorcycles Ltd y Edelweiss Bike Travel no intercambiarán correspondencia acerca de cualquier aspecto del premio.

Si el método elegido es arbitraje, se realizará conforme a las reglas de la American Arbitration Association. Cada parte implicada cargará con los costes de cualquier representación legal, revelación de pruebas o investigación que sean necesarios para finalizar el juicio arbitral. La existencia de cualquier arbitraje o sus resultados serán tratados como asuntos de carácter confidencial.
Términos de la cláusula de renuncia del motociclista
1. El participante comprende que existen riesgos y peligros inherentes a la utilización de cualquier motocicleta. El firmante asume todos los riesgos y peligros asociados con su participación en el Tour. El participante acepta cargar con la responsabilidad exclusiva por cualquier acción legal de tipo civil o criminal que pueda surgir como resultado de lesiones personales o daños a la propiedad causados por él/ella o su manipulación de la moto Tiger.
2. El participante renuncia a todos los derechos de hacer valer cualquier reclamación contra Edelweiss, empresas relacionadas, asociados comerciales, compañías aseguradoras, compañías relacionadas y todos sus empleados, por cualquier daño, incluidos los daños que resulten de negligencia, imprudencia temeraria, cualquier supuesto defecto del producto o cualquier otra reclamación que presuntamente surja como resultado de utilizar la moto Tiger.
El participante renuncia permanentemente a todos los derechos de iniciar procedimientos legales contra Edelweiss, empresas relacionadas, asociados comerciales, compañías aseguradoras, compañías relacionadas y todos sus empleados, por cualquier daño, incluidos los daños que resulten de negligencia, imprudencia temeraria, cualquier supuesto defecto del producto o cualquier otra reclamación que presuntamente surja como resultado de utilizar la moto Tiger. El participante comprende y está de acuerdo en que este documento de renuncia vincula a todos los miembros de su familia, a sus herederos y cesionarios.
3. El participante libera permanentemente de responsabilidad a Edelweiss, empresas relacionadas, asociados comerciales, compañías aseguradoras, compañías relacionadas y todos sus empleados, por cualquier reclamación, demanda y proceso judicial, incluidas reclamaciones por negligencia, imprudencia temeraria, cualquier supuesto defecto del producto o cualquier otra reclamación, realizada por cualquier persona contra Edelweiss, empresas relacionadas, asociados comerciales, compañías aseguradoras, sus compañías relacionadas y todos sus empleados, por cualquier daño que surja como consecuencia de usar la moto Tiger.
4. Por el presente documento, el participante declara que dispone de carné de moto en vigor que le permite conducir motocicletas. El participante también declara que posee la destreza de conducción en moto necesaria para montar con seguridad en la moto Tiger.
5. El participante está de acuerdo en no conducir la moto Tiger después de haber consumido alcohol o drogas. El participante reconoce que es ilegal conducir la moto en cuestión mientras se está bajo la influencia de alcohol o drogas. El participante acepta asumir la responsabilidad exclusiva por cualquier multa o daño que surja al utilizar de la moto Tiger cuando se encuentra bajo los efectos del alcohol y/o las drogas.
6. No está permitido conducir la moto fuera de carretera que no sea parte de la ruta del Tour. El participante está de acuerdo en que cualquier daño causado por la conducción no autorizada fuera de carretera deberá ser pagado completamente por el participante sin ninguna deducción.
7. El participante reconoce que la moto que le proporciona Edelweiss ha sido conducida antes. El participante será responsable de la inspección de la motocicleta antes de cada recorrido. El participante reconoce que ha inspeccionado la moto Tiger prestada y declara que se encuentra en una condición que permite su conducción con seguridad. Si el participante tiene alguna preocupación o duda sobre la condición de la moto para ser conducida con seguridad, el participante no deberá utilizar la motocicleta y deberá informar a Edelweiss sobre las razones de su preocupación sobre la seguridad de la moto.
8. El participante está de acuerdo en respetar todas las leyes de tráfico mientras utiliza la moto Tiger. El participante acepta llevar casco. El participante también reconoce que Edelweiss ha recomendado a todos los participantes del tour que lleven guantes, botas, protección ocular, mangas largas y pantalones largos mientras utilizan la moto Tiger.
9. El participante acepta que Edelweiss y/o Triumph tengan el derecho de usar su nombre, parecido y apoyo o preferencias, o cualquier reproducción de ello, en cualquier forma, estilo o color, además de cualquier escrito u otro material publicitario con relación a lo anterior, incluidos sin limitación a anuncios de televisión, películas documentales, anuncios de revistas y periódicos, materiales en puntos de venta y otros materiales que se refieran a la preferencia del participante por Edelweiss Tours y/o las motos Triumph.
10. El participante acepta que Edelweiss y/o Triumph tengan el derecho de ponerse en contacto con él/ella por teléfono, correo electrónico o correo postal.

Triumph Adventure Tour - Concours Maroc

Conditions générales du concours

Prix : Droit d'inscription individuel pour piloter une moto Triumph au cours d'un Triumph Adventure Tour (le « Tour ») personnalisé à travers l'Espagne et le Maroc, fourni par Edelweiss Bike Travel du 9 mars 2012 au 20 mars 2012. Aucun passager n'est autorisé sur le Tour. Le prix comprend les vols, les transferts entre aéroports, les repas, les boissons accompagnant le repas du soir, le carburant, les frais de bateau et la tenue (hors casques).

Pas d'échange contre espèces : Le prix ne peut pas être échangé contre une somme en espèces et ne peut être cumulé à aucune autre offre.

Éligibilité : Le prix est ouvert à toutes les personnes s'inscrivant au concours « À la recherche d'explorateurs » âgées de 21 ans ou plus, titulaires du permis A, à l'exception des salariés de Triumph Motorcycles Ltd et d'Edelweiss Bike Travel. Les personnes s'inscrivant au concours doivent être préparées et aptes à parcourir 2 700 km (1 700 miles) à moto.

Une seule inscription par personne : Une seule inscription par personne.

Clôture des inscriptions : La date de clôture des inscriptions est fixée au 27 janvier 2012.

Interdiction de modifier les motos : Les motos Triumph ne pourront faire l'objet d'aucune modification.

Sélection des gagnants du prix : Les gagnants seront sélectionnés au hasard. Le tirage au sort sera effectué le 31 janvier 2012 et les gagnants seront avertis par téléphone ou par e-mail dans les 7 jours.

Nombre de gagnants du prix : 13 gagnants seront sélectionnés.

Notification aux gagnants du prix :

Les coordonnées des gagnants seront publiées sur les sites Web de Triumph Motorcycles Limited à partir du 13 février 2012 et le resteront pendant au moins 30 jours. Triumph Motorcycles Ltd et Edelweiss Bike Travel n'échangeront aucune correspondance concernant les détails du prix.

Tenue : Triumph fournira aux gagnants du prix l'intégralité de la tenue de pilotage, à l'exception des casques. Les gagnants du prix ne sont pas autorisés à porter leur propre tenue de pilotage, à l'exception de leur casque de moto sécurisé. Assurance voyage : Il est de la responsabilité des gagnants du prix de fournir leur propre assurance voyage, qui doit couvrir l'Espagne et le Maroc.

Assurance moto : L'assurance moto sera prise en charge par Triumph Motorcycle.

Attestations de permis A et d'assurance voyage : Il sera demandé aux gagnants du prix de présenter l'original de leur permis A et de leurs papiers d'assurance voyage (les « Documents ») au personnel d'Edelweiss ou de Triumph avant le prêt des motos Triumph. La fourniture des Documents est une condition préalable au prêt de la moto Triumph.

Publicité/Droits d'auteur : Tous les participants doivent accepter de prendre part à toute forme de publicité. Le nom, le logo et les marques de commerce Triumph appartiennent à Triumph et sont protégés par les droits d'auteur. Triumph acquiert le droit de photographier tous les gagnants. Toutes les photographies et toutes les descriptions des gagnants et du Tour sont la propriété exclusive de Triumph, qui les utilisera à des fins commerciales à sa seule discrétion sans verser aucun dédommagement aux gagnants. Les marques de commerce, les logos et les marques de service (les « Marques ») de Triumph appartiennent à Triumph, à ses filiales ou à d'autres tiers. Rien, pendant le Tour, ne doit être interprété comme conférant par voie de conséquence, par préclusion ou autrement, une licence ou un droit d'utiliser toute Marque affichée sur le Tour sans l'autorisation écrite de Triumph. L'utilisation abusive par le gagnant du prix des Marques affichées sur le Tour, ou de tout autre contenu présent sur le Tour, est strictement interdite. Les gagnants du prix sont prévenus que Triumph fera énergiquement valoir ses droits de propriété intellectuelle dans toute la mesure autorisée par la loi, y compris par l'engagement de poursuites judiciaires.

Acceptation des Conditions générales d'Edelweiss Bike Travel : Les gagnants du prix doivent accepter toutes les Conditions générales requises par Edelweiss Bike Travel. Si l'arbitrage est choisi, il sera réalisé dans le respect des règles de l'American Arbitration Association. Si l'arbitrage est choisi par l'une des parties dans le cadre d'une Réclamation, Triumph et le gagnant du prix n'auront le droit ni d'intenter une action en justice, ni de réclamer un procès devant jury, ni d'engager une enquête préalable à l'arbitrage concernant cette Réclamation, sauf dans la mesure des règles d'arbitrage applicables ou dans le cas d'un accord entre les parties impliquées. En outre, le gagnant du prix n'aura aucun droit de participer en qualité de représentant ou de membre d'un groupe de requérants dans le cadre d'une Réclamation. L'arbitrage se déroulera exclusivement à White Plains, New-York. Tout tribunal compétent peut prononcer un jugement sur la décision arbitrale. 1. Le/la participant(e) comprend que le pilotage d'une moto implique toujours des risques et des dangers. Il/Elle assume tous les risques et dangers associés à sa participation au Tour. Le/la participant(e) accepte d'être l'unique responsable de toute action civile ou pénale susceptible de découler de toutes blessures corporelles ou de tout dégât matériel provoqué par lui/elle ou par son pilotage de la moto Tiger.
2. Le/la participant(e) renonce à tout droit de revendiquer toute réclamation contre Edelweiss, ses sociétés associées, ses partenaires commerciaux, ses sociétés d'assurance, ses sociétés associées et tous leurs employés pour tout dommage, y compris les dommages résultant d'une négligence, d'une négligence grave, de tout défaut de produit présumé ou de toute autre réclamation, découlant prétendument de l'usage de la moto Tiger.
Le/la participant(e) renonce définitivement à toute poursuite contre Edelweiss, ses sociétés associées, ses partenaires commerciaux, ses sociétés d'assurance, ses sociétés associées et tous leurs employés pour tout dommage, y compris les dommages résultant d'une négligence, d'une négligence grave, de tout défaut de produit présumé ou de toute autre réclamation, découlant prétendument de l'usage de la moto Tiger. Le/la participant(e) comprend et convient que cette clause de renonciation est exécutoire pour tous les membres de sa famille, ses héritiers et ayants droit.
3. Le/la participant(e) tiendra définitivement Edelweiss, ses sociétés associées, ses partenaires commerciaux, ses sociétés d'assurance, ses sociétés associées et tous leurs employés indemnes de toute réclamation, demande et procès, y compris les réclamations pour négligence, négligence grave, tout défaut de produit présumé ou toute autre réclamation par quiconque contre Edelweiss, ses sociétés associées, ses partenaires commerciaux, ses sociétés d'assurance, ses sociétés associées et tous leurs employés pour tous les dommages résultant de l'usage de la moto Tiger. 4. Le/la participant(e) déclare par la présente être titulaire d'un permis de conduire en cours de validité et non révoqué lui permettant de piloter des motos. Le/la participant(e) affirme également qu'il/elle jouit des compétences de pilotage requises pour piloter la moto Tiger en toute sécurité.
5. Le/la participant(e) convient de ne pas piloter la moto Tiger après avoir consommé de l'alcool ou des drogues. Le/la participant(e) reconnaît qu'il est illégal de piloter la moto en question sous l'emprise de l'alcool ou de drogues. Le/la participant(e) accepte de prendre l'entière responsabilité de toutes les contraventions et dommages résultant du pilotage de la moto Tiger sous l'emprise de l'alcool et/ou de drogues.
6. Le pilotage en dehors de la route du Tour est interdit. Le/la participant(e) convient que tout dommage résultant d'un pilotage hors de la route devra être intégralement payé par le participant, sans possibilité de déduction.
7. Le/la participant(e), reconnaît que la moto fournie par Edelweiss a déjà été utilisée. Le/la participant(e) sera responsable de l'inspection de la moto avant chaque pilotage. Le/la participant(e) reconnaît avoir examiné la moto Tiger prêtée et confirme son bon état de marche. Si le/la participant(e) a un doute quelconque sur la possibilité de piloter la moto en toute sécurité, le/la participant(e) ne devra pas utiliser la moto et devra expliquer à Edelweiss ce qui motive ce doute sur la sécurité de la moto.
8. Le/la participant(e) accepte de respecter le code de la route pour piloter la moto Tiger. Le/la participant(e) accepte de porter un casque. Le/la participant(e) reconnaît également qu'Edelweiss a conseillé à tous les participants au Tour de porter des gants, des bottes, des lunettes de protection, des manches longues et des pantalons longs pour piloter la moto Tiger.
9. Le/la participant(e) convient qu'Edelweiss et/ou Triumph aura le droit d'utiliser son nom, son portrait et son approbation ou toute reproduction de ces derniers, quels que soient la forme, le style ou la couleur, ainsi que tout texte ou autre support publicitaire relatif y compris, mais sans s'y limiter, les publicités télévisées, les films documentaires, les publicités de magazines ou de journaux, les supports de points de vente et autres supports relatifs à la préférence du/de la participant(e) pour Edelweiss Tours et/ou pour les motos Triumph.
10. Le/la participant(e) convient qu'Edelweiss et/ou Triumph ont le droit de le/la contacter par téléphone, par e-mail ou par courrier.
Le/la participant(e) reconnaît comprendre l'anglais. Le/la participant(e) reconnaît avoir lu et compris cette clause de renonciation. Le/la participant(e) accepte les Conditions générales de cette clause de renonciation.

 

 

 

 

 

Triumph Adventure Tour - Morocco Competition

I/Le concorrenti devono prepararsi ed essere capaci di intraprendere un viaggio in strada in motocicletta di 1700 miglia (2700 km).

Ai/Alle vincitori/vincitrici non è consentito indossare il proprio equipaggiamento, escluso un casco da motocicletta per la sicurezza personale. Triumph si riserva il diritto ad applicare un logo adesivo temporaneo per la durata del giro.

Assicurazione di viaggio: I/Le vincitori/vincitrici sono responsabili per l'esibizione della propria assicurazione di viaggio, che deve essere valida in Spagna e Marocco.

Assicurazione del veicolo: La copertura assicurativa per il veicolo a motore sarà fornita da Triumph Motorcycles.

Prova del possesso di patente per motocicli valida e di assicurazione di viaggio: I/Le vincitori/vincitrici dovranno presentare l'originale della patente per motocicli valida e la documentazione relativa all'assicurazione di viaggio ("Documenti") allo staff Triumph o Edelweiss prima del prestito dei motocicli Triumph. La fornitura dei documenti è un prerequisito per il prestito del motociclo Triumph.

Pubblicità/Copyright: Tutti i/le concorrenti devono garantire la propria partecipazione a eventuali iniziative pubblicitarie. Il nome, il logo e i marchi registrati Triumph sono di proprietà protetta da copyright Triumph. Triumph acquisisce il diritto a fotografare tutti i/le vincitori/vincitrici. Tutte le fotografie e le raffigurazioni dei/delle vincitori/vincitrici e del giro sono di esclusiva proprietà di Triumph per utilizzo commerciale a unica discrezione di Triumph, senza alcun compenso per i/le vincitori/vincitrici. Triumph acquisisce il diritto ad utilizzare i nomi e le immagini dei/delle vincitori/vincitrici a beneficio commerciale di Triumph nel pubblico dominio attraverso media sociali a scelta da parte di Triumph, inclusi, ma senza alcun limite, Facebook, Twitter, YouTube, MySpace, Google+, Bebo, Flickr e/o Tumblr. I marchi registrati, loghi e marchi di servizio ("Marchi") di Triumph, sono proprietà di Triumph, dei suoi affiliati o altre terze parti. Durante il giro, niente dovrebbe essere interpretato come concessione, per implicazione, preclusione, o altrimenti, di qualsiasi licenza o diritto all'uso di qualsivoglia Marchio visualizzato durante il giro, senza il previo consenso scritto da parte di Triumph. È severamente proibito l'utilizzo improprio da parte del/della vincitore/vincitrice dei Marchi o di altri contenuti del giro visualizzati durante il giro. I/Le vincitori/vincitrici sono avvisati che Triumph farà rispettare con forza i propri diritti di proprietà intellettuale nella misura massima consentita dalla legge, inclusa la possibilità di avviare azioni penali.

Benestare ai termini e alle condizioni di Edelweiss Bike Travel: I/Le vincitori/vincitrici devono concordare con i termini e le condizioni stabiliti da Edelweiss Bike Travel. I/Le vincitori/vincitrici devono firmare tutti moduli richiesti da Edelweiss Bike Travel.

Scelta della giurisdizione: Il concorso e il giro sono soggetti alle leggi dell'Inghilterra.

Diritto di recesso: Triumph Motorcycles si riserva il diritto di modificare o ritirare la promozione in qualsiasi momento e senza preavviso.
Arbitrato: Qualsiasi rivendicazione, disputa, o controversia (nel contratto, d’illecito o altrimenti, preesistente, presente o futura, e incluse ma senza alcun limite, legislazione, diritto consuetudinario, illeciti internazionali e giuste rivendicazioni) derivante o relativa al premio, il giro, l'interpretazione o l'applicazione di questi termini e condizioni, o la violazione, cessazione o validità, le relazioni conseguenti a questi termini e condizioni o a qualsiasi altra pubblicità o attività di marketing da parte di Triumph (collettivamente una "Rivendicazione"), VERRÀ RISOLTA DOPO L'ELEZIONE DI TUTTI/E I/LE VINCITORI/VINCITRICI DEI CONCORSI TRIUMPH O DELLE TERZE PARTI COINVOLTE, ESCLUSIVAMENTE E DEFINITIVAMENTE TRAMITE ARBITRATO RITUALE. In caso di scelta dell'arbitrato, questo verrà condotto in base alle regole dell'American Arbitration Association. In caso di scelta dell'arbitrato da parte di qualsiasi parte in relazione alla rivendicazione, né Triumph né il/la vincitore/vincitrice avranno il diritto ad avviare un'azione legale in tribunale in relazione alla rivendicazione, ad avere un processo con giuria, o iniziare un'esibizione pre-arbitrato, eccetto dove previsto nelle regole di arbitrato applicabili o tramite accordo tra le parti coinvolte. Inoltre, il/la vincitore/vincitrice non avrà diritto a partecipare come rappresentante o membro di qualsiasi classe di rivendicazione, in relazione a qualsiasi rivendicazione. L'arbitrato avrà luogo esclusivamente a White Plains, New York. Qualsiasi corte avente giurisdizione può depositare la sentenza in base al giudizio del giudice arbitrale. Le parti coinvolte provvederanno ai propri costi legali, di scoperta o ricerca per il completamento dell'arbitrato. L'esistenza o i risultati di qualsiasi arbitrato verranno trattati in maniera confidenziale.
Termini di rinuncia del/della partecipante
1. I/Le partecipanti comprendono la presenza di rischi e pericoli inerenti all'utilizzo dei motocicli. L'interessato/a si assume tutti i rischi e i pericoli associati con la sua partecipazione al giro. I/Le partecipanti concordano ad assumersi la responsabilità connessa a qualsiasi azione civile e penale che possa nascere da qualsiasi danno fisico o alla proprietà causato dal/dalla partecipante o dalle sue operazioni con la motocicletta Tiger.
2. Il/La partecipante rinuncia a qualsiasi rivendicazione nei confronti di Edelweiss, delle società affiliate, dei partner commerciali, delle compagnie di assicurazione e di tutti i relativi dipendenti per qualsiasi danno causato da grave negligenza, qualsiasi presunto difetto del prodotto o altre rivendicazioni, causate presumibilmente dall'utilizzi del motociclo Tiger.
I/Le partecipanti rinunciano permanentemente a qualsiasi diritto a citare Edelweiss, le società affiliate, i partner commerciali, le compagnie di assicurazione e le società affiliate e tutti i relativi dipendenti per qualsiasi danno causato da grave negligenza, qualsiasi presunto difetto del prodotto o altre rivendicazioni, causate presumibilmente dall'utilizzo del motociclo Tiger. Il/La partecipante comprende e conviene che questa rinuncia è vincolante a tutti i propri membri familiari, eredità e cessioni.
3. Il/La partecipante terrà indenne in maniera permanente Edelweiss, le società affiliate, i partner commerciali, le compagnie di assicurazione e le società affiliate e tutti i relativi dipendenti riguardo a qualsiasi rivendicazione, richiesta e azione legale, incluse le rivendicazione a causa di grave negligenza, qualsiasi presunto difetto del prodotto causati da Edelweiss, le società affiliate, i partner commerciali, le compagnie di assicurazione e le società affiliate e tutti i relativi dipendenti per qualsiasi danno causato dall'utilizzo del motociclo Tiger.
4. Il/La partecipante dichiara qui di essere in possesso di una patente di guida valida e non revocata per l'utilizzo di motocicli. Inoltre, il/la partecipante afferma di essere in possesso delle capacità di guida necessarie per l'utilizzo del motociclo Tiger.
5. Il/La partecipante concorda nel non utilizzare il motociclo Tiger dopo l'assunzione di alcol o droghe. Il/La partecipante riconosce che è illegale utilizzare il motociclo sotto l'effetto di alcol o droghe. Il/La partecipante concorda nell'accettare la sua unica responsabilità per qualsiasi contravvenzione e danno causato dall'utilizzo del motociclo Tiger sotto l'effetto di alcol e/o droghe.
6. Non è permesso condurre il mezzo fuori strada, all'esterno del percorso del giro. Il/La partecipante conviene che qualsiasi danno causato da guida fuori strada non autorizzata, dovrà essere risarcito interamente dal/dalla partecipante, senza nessun importo deducibile.
7. Il/La partecipante riconosce che il motociclo fornita da Edelweiss è stato utilizzato in passato. Il/La partecipante sarà responsabile per l'ispezione del motociclo prima di qualsiasi utilizzo. Il/La partecipante riconosce di aver esaminato il motociclo Tiger concesso in prestito e afferma che il suo stato di utilizzo è sicuro. Qualora il/la partecipante abbia qualsiasi dubbio riguardante la capacità di utilizzo sicuro del motociclo, è tenuto/a a rinunciare al suo utilizzo e informerà Edelweiss riguardo a qualsiasi ragione connessa la dubbio sull'utilizzo sicuro del motociclo.
8. Il/La partecipante concorda con il rispetto di tutte le norme sul traffico durante l'utilizzo del motociclo Tiger. Il/La partecipate concorda con l'utilizzo di un casco. Inoltre, il/la partecipante riconosce che Edelweiss raccomanda a tutti l'utilizzo di guanti, stivali, protezioni per gli occhi, maniche lunghe e pantaloni lunghi durante l'utilizzo del motociclo Tiger.
9. Il/La partecipante concorda che Edelweiss e/o Triumph avranno il diritto ad utilizzare il suo nome, somigliante o approvato o qualsiasi relativa riproduzione, in qualsiasi forma, stile, colore, insieme a qualsiasi scritta o altro materiale pubblicitario connesso, inclusi ma senza alcun limite, pubblicità televisive, documentari, pubblicità su riviste e quotidiani, materiali dei punti vendita, e altri materiali relativi alla preferenza del/della partecipante per Edelweiss Tours e/o motocicli Triumph.
10. Il/La partecipante concorda che Edelweiss e/o Triumph hanno il diritto di contattarlo/a telefonicamente, tramite e-mail o posta ordinaria.
Il/La partecipante riconosce di comprendere la lingua inglese. Il/La partecipante riconosce di aver letto e compreso questa rinuncia. Il/La partecipante concorda con i termini di questa rinuncia.

 

 

 

 

 

Triumphアドベンチャー・ツアー ‐ モロッコレース

レースの条件

賞品:Edelweiss Bike Travel(エーデルワイス・バイク・トラベル)が主催し、スペインとモロッコで行われる冒頭のTriumphアドベンチャー・ツアー(以下、「ツアー」)」でTriumphオートバイに乗って出場する単独出場権、開催日程は2012年3月9日~3月20日 ツアーには同乗者は認められません。賞品は航空券、空港からの送迎、食事、夕食時の飲み物、ガソリン、フェリー代金、バイク用品(ヘルメットは除く)がすべて含まれています。

現金の支給はなし:賞品には現金の支給はなく、他のオファーと併用しての利用はできません。

応募資格:21才以上でオートバイの正式免許を持ち「探検家探し」レースに応募する応募者全員が対象です。ただし、Triumph Motorcycles Ltd とEdelweiss Bike Travelの従業員は除きます。レースの出場者には、全長1700マイル(2700キロメートル)のオートバイレースでの走行が求められます。

応募は一人1回:応募は一人1回のみです。

オートバイの改造禁止:Triumphのオートバイの改造は禁止します。

当選者の抽選:抽選により当選者を決定します。抽選は2012年1月31日、当選者には7日以内に電話または電子メールで通知します。

当選者数:当選者は13名です。

当選者への通知:

当選者の詳細はTriumph Motorcycles Limitedのウェブサイトに2012年2月13日から最低30日以上掲載する予定です。 Triumph Motorcycles Ltd と Edelweiss Bike Travelは賞品に関しては一切協議をしません。

装備:当選者にはTriumphからヘルメットを除いた全ての装備が支給されます。当選者には私物の安全用ヘルメット以外のバイク用具の着用は認められません。Triumphはツアー期間中、ヘルメットに社名ロゴを貼付する権利を留保します。

旅行保険:当選者はスペインとモロッコへの旅行保険にご自分で加入してください。

正式免許と旅行保険の提示:当選者はTriumphオートバイの貸与に先立ち、オートバイの免許証と旅行保険証書(以下、「書類」)をEdelweiss またはTriumphのスタッフに提示してください。書類の提示がない場合、Triumphオートバイは貸与されません。

宣伝/著作権:応募者全員があらゆるメディアへの露出に同意するものとします。Triumphの社名、ロゴ、商標は保護されているTriumphの著作権です。Triumphは当選者全員の写真の撮影権を有します。当選者とツアーに関する写真や記述はTriumphのみの裁量で商業目的に使用できる独占的財産であり、当選者に対価は支払われません。Triumphは、Facebook、Twitter、YouTube、MySpace、Google+、Bebo、Flickr、Tumblrなどのソーシャルメディアを通じて公けの場で商業目的で当選者の氏名や画像を使用する権利を取得するものとします。Triumphの書面による許可なくして、当選者が商業目的でツアーに関する写真または記述を複製、複写、表示、配布、再発行、アップロード、掲載、配信することを禁じます。Triumphの書面による許可なくして、何らかの目的でツアーの資料を使用することは、Triumphの著作権その他の独占的権利の侵害になります。Triumphの商標、ロゴ、サービスマーク(以下、「マーク」)はTriumph、その関連会社または第三者の所有物です。Triumphの書面による許可なくして、ツアー中の何ものも暗に、禁反言、その他によりツアーで表示したマークを使用する許可または権利を付与したとみなされることはありません。ツアー中、またはツアー中にその他のコンテンツで表示したマークを当選者が不正に使用することは厳禁です。Triumphは刑事訴訟を含め、法律で認められた知的裁判権を最大限積極的に執行することに当選者はご注意ください。

Edelweiss Bike Travelの条件への同意:当選者はEdelweiss Bike Travelが定めたすべての条件に同意するものとします。当選者は免責条項を含めEdelweiss Bike Travelが定めたすべての書類に署名するものとします。

準拠法:レースとツアーは英国法に準拠します。

解約権:Triumph Motorcycles はこのプロモーションを事前の予告なしに修正、変更または中止する権利を有します。
仲裁:(契約、不法行為、その他を問わず、事前に存在していたか、現存、将来にわたるかにかかわらず、法定、コモンロー、故意の不法行為、衡平上のクレームなどを含め)賞品、ツアー、条件の解釈または適用、条件の違反、解約、有効性、条件から生じる関係、またはTriumphの広告もしくはマーケティングから生じるかそれに関係するクレーム、紛争、論争(まとめて、「クレーム」)は、Triumph、当選者または関係する第三者が選んだ法的拘束力を有する仲裁により独占的、最終的に解決されるものとします。仲裁が選択された場合、米国仲裁協会の規則にしたがって行われます。クレームについて当事者が仲裁を選択した場合、適用される仲裁規則に定められているか、関係当事者が合意した場合を除き、Triumphまたは当選者がそのクレームについて訴訟を起こしたり、そのクレームを陪審員裁判に持ち込んだり、仲裁に先立つ証拠開示手続きを行わないものとします。さらに、当選者はクレームに関するいかなるクラスの請求者の代理人またはメンバーとして参加する権利を有さないものとします。仲裁はニューヨーク州ホワイト・プレーンズで独占的に行われます。裁判管轄権を有する裁判所は仲裁人の裁定について判断を下すことができます。関係する各当事者は、仲裁を完了するのに必要な法的代理人、証拠開示手続き、調査にかかる費用を自己負担するものとします。仲裁した結果の存在は機密として扱います。
運転者の免責条項
1.出場者はオートバイの運転にはリスクと危険がつきものであることを理解しています。署名者はツアーへの参加に関連するすべてのリスク、危険要因、危険を負うものとします。 出場者 は自分が原因、またはTigerオートバイの運転による負傷や器物の破損から生じる民事および刑事訴訟の全責任を負うことに同意します。
2.出場者 は過失、重大過失、製品の欠陥、その他Tigerオートバイの使用が原因と思われるすべての損害について、Edelweiss、関連会社、ビジネスパートナー、保険会社、関連会社、その全ての従業員に賠償請求を行う権利を放棄します。
出場者 は過失、重大過失、製品の欠陥、その他Tigerオートバイの使用が原因と思われるすべての損害について、Edelweiss、関連会社、ビジネスパートナー、保険会社、関連会社、その全ての従業員を訴える権利を放棄します。 出場者はこの権利放棄が家族全員、相続人、譲受人に対して法的拘束力を有することを理解し同意します。
3.出場者はTigerオートバイの使用から生じるすべての損害についてEdelweiss、関連会社、ビジネスパートナー、保険会社、関連会社、その全ての従業員に対する過失、重大な過失、製品の欠陥、その他の申し立てについて、Edelweiss、関連会社、ビジネスパートナー、保険会社、関連会社、その全ての従業員を永久に免責とします。
4.出場者はオートバイの運転を許可する無効になっていない有効な運転免許を有することをここに誓います。出場者はTigerオートバイを安全に運転するのに必要な運転技術を有することも誓います。
5.出場者はアルコールや薬物の摂取後にTigerオートバイを運転しないことに同意します。出場者はアルコールまたは薬物を摂取した状態で当該オートバイを運転することは法律違反であることを認めます。出場者はアルコールや薬物を摂取した状態でTigerオートバイを運転することから生じる罰金や損害の全責任を負うことに同意します。
6.ツアーのルートから外れたオフロードでの運転を禁止します。 出場者は未許可のオフロード走行による損害について、出場者が控除免責金額のない全額を支払うことに同意します。
7.出場者はEdelweissから貸与されるオートバイは中古車であることを認めます。出場者は運転する前に必ずオートバイを調べる責任があります。出場者は貸与されたTigerオートバイを調べて、安全に走行できる状態であることを認めます。出場者にオートバイを安全に運転できるか懸念がある場合、 出場者はオートバイの使用を控え、Edelweissにオートバイの安全性を懸念する理由を伝えるものとします。
8.出場者はTigerオートバイの運転中、交通法規を順守することに同意します。出場者はヘルメットの着用に同意します。出場者はEdelweissがツアーの出場者全員にTigerオートバイを運転する際に手袋、ブーツ、ゴーグル、長袖長ズボンの着用を推奨していることも認めます。
9.出場者はEdelweissまたはTriumphが出場者がEdelweiss のツアーやTriumphのオートバイを好むことを伝えるテレビコマーシャル、ドキュメンタリー、雑誌と新聞広告、店頭資料、その他の資料とともに、形式、スタイル、色を問わず、出場者の氏名、似顔絵、推薦の言葉、複製を使用する権利を有することに同意します。
10.出場者はEdelweiss またはTriumphが電話、電子メールまたは郵便で連絡する権利を有することに同意します。
出場者は英語を理解することを認めます。出場者はこの免責条項を読んで理解したことを認めます。出場者はこの免責条項の条項に同意します。
